1. Acceptance of Terms
By accessing or using Alculator ("the Service"), operated at alculator.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Alculator is a web-based beverage pricing calculator designed for the alcohol and non-alcoholic beverage three-tier distribution system. The Service allows users to model forward and reverse pricing, manage pricing portfolios, and export pricing data.
3. Account Registration
To access certain features, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
4. Free and Paid Plans
Alculator offers a free tier and paid subscription plans (Starter and Pro). Free accounts have limitations on the number of markets, SKUs, and export capabilities. Paid plans unlock additional features as described on our pricing page.
We reserve the right to modify plan features and pricing with reasonable notice. Existing subscribers will be notified of material changes at least 30 days in advance.
5. Payment and Billing
Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellations take effect at the end of the current billing period.
Refunds are handled on a case-by-case basis. If you believe you were charged in error, please contact us within 30 days.
6. User Content
You retain ownership of all pricing data, brand names, and other content you enter into the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.
We do not claim any intellectual property rights over your User Content. We will not share, sell, or use your pricing data for any purpose other than delivering the Service.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other user accounts
- Interfere with or disrupt the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated scripts or bots to access the Service
- Resell or redistribute the Service without written permission
8. Intellectual Property
The Service, including its design, code, content, and branding, is owned by Alculator and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Pricing calculations are tools for estimation and planning purposes only. Alculator does not provide financial, tax, or legal advice. You are solely responsible for verifying all pricing decisions and ensuring compliance with applicable laws and regulations in your jurisdiction.
10. Limitation of Liability
To the maximum extent permitted by law, Alculator and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, lost profits, or loss of data.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Alculator, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination using the Service's export features.
You may delete your account at any time by contacting us. We will delete your data within 30 days of the request.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
